Your use of this website is subject to the following Terms and Conditions of Use. These Terms and Conditions of Use along with the Privacy Policy, form an agreement regulating your relationship with CARER regarding the use of the services offered on the website as well as those provided offline through personal interaction. By accessing, browsing or using this website, you acknowledge that you have read and understood these Terms and Conditions of Use and agree to be bound by them. Please read these Terms and Conditions of Use carefully and ensure that you understand them before you use this website or avail of CARER’s services. If you are not agreeable to any of these Terms and Conditions of Use or the terms contained in the Privacy Policy, please do not use this website or subscribe for the services. These Terms and Conditions of Use are subject to change and CARER may, without prior notice to you and at any time, revise the same and any other information contained in this website by updating these Terms and Conditions of Use. CARER may also make improvements or changes in the services provided by it as described in this website at any time without notice. CARER grants you a non-exclusive and non-transferable, limited permission to access and view the web pages within this website. II. About CARER’s Services

CARER aims at an integrative and holistic recovery for cancer by providing the following two services:

CARER Program

CARER Program is an offline personalized homecare program which aims at providing holistic healing, therapy and carer coaching to cancer patients and survivors undergoing treatment through personal interactions with nutritionists, meditation trainers, yoga therapists and other specialists in allied holistic treatment services.

CARER Online

CARER Online is a cancer recovery and rehabilitation program which aims at providing holistic healing advice online to post-treatment cancer patients through lifestyle changes, nutrition advice and movement and mind-body healing techniques.
Please note that CARER does not provide or claim to provide any medical treatment for cancer and merely provides advice and assistance through holistic techniques during and post cancer treatment for a healthy living. Please do not consider the techniques and advice given by the specialists under CARER Program or available on this website as a substitute for medical treatment. You are always advised to consult your personal doctor or primary healthcare provider prior to acting upon such techniques and advice. It is advisable that you continue with the medical treatment advised by your personal doctor and the advice and suggestions given by the specialists and/or available on this website are to be followed only in addition to such medical treatment and not as an alternative to medical treatment. A detailed description of the services provided by CARER is available on the website. For the purposes of the Terms and Conditions of Use, the term ‘personal doctor’ shall mean the doctor, primary healthcare provider or institute providing you with medical treatment for cancer.

III. Registration Procedure

Below the tabs mentioned on the website, you will find an option to Login/Sign-up with CARER. In order to Login/Sign-up with CARER, you must have purchased the program. In order to purchase the program, you will be required to click on the ‘Pricing’ page and the option you would like to purchase.

Upon clicking on the program opted for, you will be directed to the Payment option of the website. You may make the payments through the various modes provided for payment. Please note that CARER has engaged the services of the Payment Gateway, Avenues (India) Pvt. Ltd. operating under its trade name, CC Avenue, to facilitate payments. Once you click on the Proceed to Payment option, you will be redirected to the service webpage of CC Avenue. This webpage will contain the amount payable for using and accessing the CARER’s services. You will be required to provide your Billing Information and Payment Information in the fields provided on this webpage. Please note that any information provided on the web page of CC Avenue shall be governed by the terms of use and privacy policy of CC Avenue and CARER shall not be responsible for any use of the information provided to CC Avenue.

The various Payment Options available on CC Avenue are as follows:

1. Credit Cards of select financial service providers: To pay using your credit card, you will need your card number, the expiry date of the card and the three-digit CVV number of the card. You will then be redirected to your financial service provider’s secure page for entering your online password to complete the payment.

2. Debit Cards of select banks: To pay using your debit card, you will need your card number, the expiry date of the card and the three-digit CVV number of the card. You will then be redirected to your bank’s secure page for entering your online password to complete the payment.

3. Net Banking: You may also avail your bank’s Internet banking services to make payments if such bank is displayed in the list of banks displayed by CC Avenue.

4. Cash Card facility of service providers as available on CC Avenue;

5. Mobile Payments through service providers as available on CC Avenue; and

6. Payments using Wallets of service providers as available on CC Avenue.

CARER also permits you to make payments in installments and provides an EMI facility using Credit / Debit Cards of select banks.

In order to process and complete the payment, you must click on the Make Payment option. Post payment you will be taken to your dashboard in which you can sign into at all times, through the Login tab on the top right hand of the screen. You hereby undertake to provide true, accurate and up – to – date information while signing up for the CARER’s services.
You may sign out of your account at any time. Please note that once you have signed out of your account, you will only be permitted to access portions of the website which are open to the public and not those which are specifically accessible to registered users of the website.

IV. The CARER Program

CARER Program is a program designed and customized to suit the needs of every cancer patient undergoing treatment.
As a part of the CARER Program and prior to subscribing to any service under CARER Program, you will have an opportunity to consult a CARER coach, to help you determine the services best suited for you. This initial consultation with the CARER Coach may be either by way of a detailed telephonic conversation or through a personal face-to-face interaction. However, in every case, this initial consultation will be free of charge to you. The CARER coach will, based on your needs and/or requirements, determine a Personalised program for you and the services, stated below, either individually or as a combination of two or more services.

The initial consultation with the CARER coach is an option provided to you under CARER Program, which you may or may not choose to exercise, prior to subscription to any of the services.
In all cases you may, at your sole discretion, subscribe to any of the services, mentioned below, either individually or as a combination of two or more services.

1. Personalised Diet and Nutrition- This service is provided over a period of 8 weeks where the focus is on your intensive diet and nutrition. A personal nutritionist and specialist will aim at building your immune system through personalised diet charts suited for you. This will be created after considering your medical reports, background history and meal preferences. As a part of this service, we offer you 4 (four) telephonic conversations with your personal nutritionist, where you can interact with the nutritionist in intervals of 2 weeks for a period of 8 weeks. Further you will also have access to frequent text/ email interactions with your nutritionist. However, all interactions, whether telephonic and/or email/text, will be scheduled only from Monday to Saturday and no interactions will take place on Sundays, except in case of emergencies. The dietary and nutritional plans formulated for you, will undergo changes, during this period of 8 weeks, subject to your progress and other health conditions.

2. Holistic Health and Cancer Coach

a) Holistic Health Coaching for Disease Prevention

Our coach at CARER will help you live a balanced, healthy and disease free life by coaching and guiding you on holistic healing and how to achieve optimal health. This service would include guidance in areas of health, lifestyle, food and dietary habits, exercise, weight loss or gain, gastric and digestive problems, acidity, work life balance, stress management, sleep management and help you in implementing permanent lifestyle changes.
This service will be provided to you over a period of 8 weeks (2 months) where the coach at CARER will interact with you either through personal one-on-one sessions (excluding travel expenses) or through a telephonic call or Skype every week, once a week.

b) Holistic Cancer Coaching

As a part of this service, our coach, Samara Mahindra, will focus on coaching you through building immunity and healing the body and mind, whether you are going through treatment or post treatment. You will be provided guidance in areas of health, lifestyle, building immunity through food and dietary habits, managing and healing emotional and mental disturbances, movement , exercise and lymphedema workout, sleep management and educate you on decreasing chances of relapse and help you in implementing permanent lifestyle changes..

This service will be provided to you over a period of 8 weeks (2 months) where the coach at CARER will interact with you either through personal one-on-one sessions (excluding travel expenses) or through a telephonic call or Skype every week, once a week.

3.Yoga Therapy for cancer

Cancer has major physical strains on the body. Loss of muscle mass and range of motion might be affected due to surgeries. Therefore this plan is focused on making you physically strong with specialised Yoga Therapists who know how to work with cancer.
Your personal Yoga Therapist will help you with yoga postures that deal with physical and mental strains of cancer. We believe it’s important to keep body fat percentages low and build muscle strength, and so as a part of this service our Yoga Therapist will focus on stretching and strengthening of muscles along with stimulating the digestive system, lymphatic system and circulatory system along with breathing techniques that help in balancing the body and mind. We at CARER recommend you to avail this service for a period of

3 months (12 weeks), where you will be assigned a personal Yoga Therapist for a total of 20 yoga sessions in the comfort of your home. Further it is recommended that this service be availed once a week for the first month and gradually increased to twice a week for two months. In every case, the Yoga Therapist assigned to you will adapt the sessions according to your strength and condition.

4.Meditation

As a part of this service, a personal meditation trainer will visit you at your home and guide you through meditations for calming your body and mind for a total of 8 sessions. This service also includes 4 sessions with a counsellor at the counsellor’s clinic, near your residence, who will personally assist you in dealing with the stress, anxieties and mental disruptions, you might be feeling during your cancer treatment process.

5. CARER Coaching

You will be provided 4 sessions with a CARER coach for consultation purposes. The coach will interact with you, either via a telephonic call or skype or through personal visits if required (travel expenses not included). This service focuses on the mental and emotional well-being of cancer patients and is provided over a period of 3 months.

V. Levels of CARER Online

The How It Works section of the website provides you with an Instruction Manual for the CARER Online, the Beginner Calendar for 12 Weeks and the Intermediate Calendar for 12 Weeks. You should read the Instruction Manual for more information on getting started before using the CARER Online. Briefly, the Instruction Manual for the CARER Online provides detailed instructions for using the services along with a list of props required for the CARER Online and the contraindications of some of the asanas and other techniques, which are a part of the CARER Online. The Beginner Calendar for 12 Weeks provides a 12-week timetable for those who wish to undertake the program within 6 (six) months of their last treatment and the Intermediate Calendar for 12 Weeks provides a 12-week timetable for those who have completed a period of 6 (six) months from their last treatment and are familiar with basic yoga practices.

Please note that irrespective of the duration since your last treatment, if you have not done any form of yoga or movement therapy or are still fatigued or weak, you should opt for the Beginner Calendar for 12 Weeks.
On the same page as these manuals, you will also find a video on yoga techniques. Below the video, you will see various levels of healing that have been devised as part of the CARER Online. These levels are as follows: Survive, Heal, Strengthen, Live, Thrive and End. Each level consists of a written component, audio clip, informative videos, practice tutorials and access to on ground counseling.

In addition to the levels of the CARER Online mentioned above, additional information, guides and techniques are available under various tabs on the website being Eat to Health, Move to Health, Meditate to Health, Knowledge to Health and For us Women.

a. Eat to Health: This tab provides you with informative health food resources, healthy cooking advice and recipes. Please note that while following the advice and recipes provided in this tab, you must exercise caution with respect to any allergies, sensitivities or restrictions under medical advice, which must be observed by you. You hereby undertake to not hold CARER liable or responsible in any manner whatsoever for any harm suffered by you owing to such allergies, sensitivities or restrictions.

b. Move to Health: This tab focuses on Lymphedema, what it is, resources for Lymph drainage garments and contains a Lymphedema exercise chart and reference to Proxima Speciality Healthcare. Please note that the exercise chart is for your reference only and you must observe prudence in choosing the exercises in accordance with your specific medical condition and your personal doctor’s advice. Further, CARER does not provide any warranty for the services of Proxima Speciality Healthcare and the information about the same has been provided to you for reference only. You may visit the website of Proxima Speciality Healthcare, through the link provided, for deciding whether to engage its services and to be bound by the terms and conditions of service of Proxima Specialty Healthcare.

c. Meditate to Health: This tab contains written content and audio clips regarding meditation techniques.

d. Knowledge to Health: This tab provides you with additional information about dealing with the side effects and provides you with a database of Integrative Specialists. Please note that the advice given under this tab is in addition to the medical treatment being received by you and constitutes general advice. You must consider your specific medical condition and treatment while following the advice we have provided. Further, please note that the database of Integrative Specialists provided to you is merely a general database of known specialists for your reference and CARER does not endorse any specialist from the database.

e. For us Women: This tab contains tips, advice and tutorials with respect to make up, hair and prosthetics and provides suggestions of organizations dealing in prosthetics. The website links for such organizations are also provided with a summary of these organizations. Please note that these organizations are mere suggestions and it is advisable that you exercise prudence before choosing to use the services of these organizations. Further, please note that you must observe caution with respect to any allergies or sensitivities that you may be suffering from, before following the advice and using the make-up techniques provided under this tab.

VI. For Your Consideration

CARER Program

1. The advice of the CARER coaches is not intended to be, nor is a substitute for professional medical advice, diagnosis or treatment provided to your by your personal doctor. CARER Program is a program developed to supplement your on-going cancer treatment to help you in holistic and integrative healing. Moreover, due to the fact that services relate to your health, you should endeavor to confirm your fitness and the best use of the services provided under CARER Program, with your personal doctor and evaluate all the services based on your personal needs.

2. Personalised Diet and Nutrition

As our nutritionist aims at drawing out, dietary plans, best suited for you, it is important that you provide all information relating to your health, current state, medical history, eating habits, allergies and all other necessary information and render all reasonable assistance and cooperation, essential to enable the nutritionist in creating a personalized plan.
Also, though the dietary plans are personalised considering all information provided by you, you are advised, always, to consult and confirm such diets with your personal doctor before following the same.

3. Holistic Health and Cancer Coaching

It is hereby clarified that any communication made between you and your coach Including all personal and sensitive information shared by you with them, will remain confidential at all times and CARER will not have any access to such information unless specifically agreed by you to be shared with CARER.

4. Yoga Therapy

It is presumed that when you sign up for our yoga therapy service, you are of reasonable health required to perform yoga. You understand that the effect of yoga techniques is subjective to every person and therefore the results of the therapy may vary depending on an individual’s constitution and level of health at the time. Further you are advised to remain in consultation with your personal doctor, physician and/or physiotherapist (if previously consulted) prior to performing any yoga techniques suggested to you under this program. Notwithstanding anything to the contrary stated herein, in all circumstances, we expressly disclaim, to the fullest extent permitted by law, all express, implied, statutory and other warranties, guarantees or representations including without limitation, as to the effectiveness of the advice, suggestions and techniques and towards any injury which may be caused/suffered on account of performance of the techniques.

5. Our coaches will undertake their best efforts to ensure effective services to you. However, when it comes to healing and treating people, results are subject to individual responses and therefore you understand that the results may vary from person to person.

6. CARER will not be liable for any loss, injury or damage (including without limitation direct, indirect, consequential, special, exemplary or punitive loss, injury or damage) suffered by anyone on account of any negligence on the part of the coaches or use/performance of the information, response, advice furnished to you by the Coaches under the program.

CARER Online-Counselling from Type A Thought

CARER also provides you with the option to avail counselling services from Type A Thought, an organisation dealing with psychological care and counselling. You may receive email communications from CARER, allowing you to schedule an appointment for counselling from Type A Thought psychologists with appropriate links guiding you to the Type A Thought website. Please note that, as a registered user of CARER, you may also avail a discount from Type A Thought for availing their services. Additionally, you may also take surveys and / or engage in an instant chat with the Type A Thought psychologists through the links provided by CARER. Type A Thought is an organisation whose services are only suggested by CARER and your relationship with Type A Thought shall be governed by the terms and conditions of use of Type A Thought and by any other contractual obligations established between you and Type A Thought. CARER shall not be responsible or liable for any acts, omissions or negligence by any person associated with Type A Thought in any manner whatsoever. Further, any information disclosed to Type A Thought shall be governed by the privacy policy of Type A Thought and by any other contractual obligations established between you and Type A Thought. CARER shall not be liable for any unauthorized use or disclosure of information made by any person associated with Type A thought in any manner whatsoever.

VII. Confidential and Personal Data / Information

Any personal and identifiable information that is required to be collected by us, in any manner whatsoever, shall be kept confidential in accordance with the provisions of our Privacy Policy. In addition to the same, the provisions of the following laws / rules / guidelines / regulations shall be applicable to the use of this website:

1. The provisions of Information Technology Act, 2000 relating to processing of personal data as may be amended from time to time;

2. The provisions of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 as may be amended from time to time.

CARER is the sole owner or lawful licensee of all the intellectual property rights including but not limited to the rights contained in this website and its content. The website content includes but is not limited to its visual content such as the design, layout, text, images, graphics, sound, video, etc. as well as the non-visual content such as the source code and other copyrightable elements of the website. The title, ownership and intellectual property rights shall remain with CARER, its affiliates or licensors of the content.

1. Trademark

‘CARER PROGRAM’ and related icons and logos are registered or registration has been applied for by CARER or its principal in various jurisdictions and the same are protected under applicable trademark and other intellectual property laws. The unauthorized copying, modification, use or publication of these marks is strictly prohibited and shall be subject to appropriate legal action against the unauthorized user.

2. Copyright

All copyrightable material provided to you in pursuance of CARER’s service, including content on this website is the copyright of CARER or its licensors except the third-party content and links to third party websites on this website, such as www.mskcc.org and www.proximahealthcare.com and any other third party links and services that may be added from time to time.

IX. Disclaimer of Warranty

While the information provided in pursuance of CARER’s services including, without limitation, information on this website has been carefully and thoughtfully compiled with the use of specialists/Counsellors, the use of the services provided by CARER or of this website at all times is at your sole risk. All materials, information and services are provided ‘as is’, with no warranties or guarantees whatsoever. CARER expressly disclaims to the fullest extent permitted by law, all express, implied, statutory and other warranties, guarantees or representations including without limitation, the effectiveness of the information, advice, suggestions and techniques and non-infringement of proprietary and intellectual property rights.

You understand and agree that CARER reserves the right to terminate your services/registration and / or terminate your right to use this website for any reason whatsoever, including without limitation, any act or omission in contravention of the Privacy Policy or of these Terms and Conditions of Use. This website is created and controlled by Wild Mandarin Cancer Connect LLP, having its principal place of business at Bangalore, India and shall be governed by the laws of India without reference to the conflict of laws. It is possible for you to obtain access to this website from any jurisdiction in the world. This website has been designed to comply with the laws of India. If any material on this website or your use of the website is contrary to the laws of the country / state where you are when you access it, we ask you not to use the website in contravention of such law.
You are responsible for being aware of the laws of your jurisdiction and complying with them. The courts in Bangalore shall have exclusive jurisdiction in respect of all the terms, conditions and disclaimers.

XIII. Dispute Resolution

All disputes or differences arising between you and CARER as to these Terms and Conditions of Use or any other matter in relation to or in connection with provision of services and/or your use of this website shall be referred to a single arbitrator who shall be appointed by CARER as per the provisions of the Arbitration and Conciliation Act, 1996 or any amendments thereto. The seat of arbitration shall be Bangalore and the language shall be English.

Headings are for reference purposes only and in no way, define, limit, construe or describe the scope or extent of such section.

The failure on the part of CARER to enforce any right or failure to act with respect to any breach by you under these Terms and Conditions of Use will not waive that right nor waive CARER’s right to act with respect to subsequent or similar breaches.

CARER shall have the right to assign its obligations and duties as mentioned herein and in any agreement relating to any or all of its services to any person or entity.

In the event that any provision of these Term and Conditions of Use is found or held to be invalid or unenforceable pursuant to any law for the time being in force, then the meaning of such provision will be construed, to the extent feasible, so as to render the provision enforceable, and if no feasible interpretation would save such provision, it will be severed from the remainder of these Term and Conditions of Use, which will remain in full force and effect.
